Cooperation Terms for Brick-and-Mortar Pharmacies

Version 1.0In force from 11 October 2026

Translation for convenience. The Polish text is binding.

Versions of the terms

§ 1 General Provisions and Parties

1.1 These Terms set out the rules on which a pharmacy receives, through the TaniejPoLek service (taniejpolek.pl), inquiries from patients in the area, answers them in the panel and hands over to the patient the prepared order against a pickup code (hereinafter: the “Cooperation Service”).

1.2 The Cooperation Service is provided by WEBET SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Opole, ul. 1 Maja 30A, 45-355 Opole, entered in the Register of Entrepreneurs of the National Court Register (Rejestr Przedsiębiorców Krajowego Rejestru Sądowego) maintained by Sąd Rejonowy w Opolu, VIII Wydział Gospodarczy Krajowego Rejestru Sądowego, under KRS number 0000940072, NIP 7543346806, REGON 520717497, share capital 5 000,00 PLN (hereinafter: the “Operator”). In the Terms of Service and in the Privacy Policy the Operator is referred to as the “Administrator” or the “Service Provider”.

1.3 The Operator’s contact point for Pharmacies, patients and authorities: biuro@webet.pl, telephone +48 798 908 242 (Mon–Fri, 9:00-17:00). The language of contact is Polish.

1.4 The Cooperation Service is intended exclusively for entities running a community pharmacy (apteka ogólnodostępna) or a pharmacy outlet (punkt apteczny) on the basis of a permit, in connection with that activity. For the Pharmacy the agreement is of a professional nature.

1.5 The Cooperation Service is provided only in Poland.

1.6 These Terms are the terms of a separate service within the meaning of clause 1.5 of the Terms of Service (taniejpolek.pl/regulamin). They are available free of charge in the Service, in the application form and in the Panel, in a form that allows them to be downloaded, stored and printed.

1.7 Using the Cooperation Service requires a device with internet access, an up-to-date web browser and an e-mail address. The Cooperation Service does not require installing software or connecting to a pharmacy system.

§ 2 Definitions

2.1 Operator — the entity indicated in clause 1.2.

2.2 Pharmacy — an entity running a community pharmacy or a pharmacy outlet that has concluded an agreement with the Operator. The agreement concerns one pharmacy, that is one premises operated on the basis of one permit.

2.3 Patient — a user of the Service who sends an Inquiry.

2.4 Service — the TaniejPoLek internet platform available at taniejpolek.pl.

2.5 Inquiry — a list of products with quantities sent by a Patient, which the Operator passes to pharmacies in the area with a request for information on the availability and price of each item. The Inquiry covers non-prescription medicines and dietary supplements from the Patient’s basket and, if the Patient has consented to it, also prescription medicines entered by the Patient in their own words.

2.6 Panel — the part of the Service available to the Pharmacy after logging in, in which the Pharmacy receives Inquiries, answers them and confirms pickup.

2.7 Answer — the Pharmacy’s information on the availability, quantity, price and any substitute of an item from the Inquiry, recorded in the Panel.

2.8 Pickup Code — a code consisting of “TPL-” and four characters, which the Service assigns to the Patient when the Patient reserves a pickup after the Pharmacy’s Answer.

2.9 Plan — a paid period of use of the Cooperation Service in one of the variants set out in clause 6.3.

2.10 Pharmacy Register (Rejestr Aptek) — the public register of pharmacies kept on the basis of the provisions of pharmaceutical law.

2.11 Law Change Day — the day on which the act amending Article 94a of the Act – Pharmaceutical Law (ustawa – Prawo farmaceutyczne) enters into force, passed by the Sejm on 18 September 2026 (Sejm paper no. 3002). The Operator notifies Pharmacies of that day by e-mail.

2.12 End of the Inquiry — the moment at which the Inquiry has been picked up, has expired, has been cancelled by the Patient, the pickup deadline has passed, or the Pharmacy has answered that it has none of the products.

§ 3 Scope of the Cooperation Service

3.1 The Cooperation Service consists in technically passing to the Pharmacy patients’ inquiries about the availability and price of the products they indicate, and in passing the Pharmacy’s Answer to the patient. The Operator does not present the Pharmacy publicly, does not place it on any list or ranking and does not recommend it to patients. The fee is remuneration for access to the Panel and for handling Inquiries; neither its amount nor the fact of payment affects which pharmacy the Inquiry reaches or in what order.

3.2 Within the Cooperation Service the Operator:

  • a) passes the Patients’ Inquiries to the Pharmacy in the order described in § 4;
  • b) provides the Panel, in which the Pharmacy answers the Inquiry, holds a text conversation with the Patient concerning that Inquiry and confirms the handing over of the order by means of the Pickup Code;
  • c) notifies the Pharmacy of Inquiries by e-mail and, if the Pharmacy switches it on, also by SMS (§ 7);
  • d) passes to the Patient the Pharmacy’s Answer together with its name, address, telephone number and opening hours and, when the Patient reserves a pickup, assigns the Patient a Pickup Code.

3.3 E-mail notifications are sent to the e-mail address of the Pharmacy’s account and cannot be switched off. The Operator sends them when: the Pharmacy receives a new Inquiry; the Pharmacy has not opened the Inquiry within 5 minutes of receiving it (one reminder); the Patient has cancelled the Inquiry; another pharmacy answered the Inquiry earlier or the Patient decided to ask a further pharmacy. The e-mail about a new Inquiry contains a list of up to eight items (name, indication of a prescription medicine, package, quantity), the distance of the Patient from the Pharmacy and the time by which an answer can be given. It does not contain the Patient’s name or telephone number.

3.4 The Pharmacy learns from the Panel of the expiry of an Inquiry, of the reservation of a pickup, of the Patient’s replies in the conversation and of the pickup of the order. The Operator does not send separate notifications about them.

3.5 The Pharmacy logs in to the Panel without a password, by means of a link sent to the e-mail address of the account. The link in the notification of an Inquiry is valid for 60 minutes, the login link for 30 minutes. A session on a given device lasts up to 30 days.

3.6 The Operator does not run a pharmacy and does not offer patients any products of its own. It does not sell or dispense medicinal products, does not accept payment from the Patient for products and does not charge the Pharmacy any commission or other fee dependent on sales. The Operator does not restrict the Pharmacy from offering the same products on other terms outside the Service.

3.7 The Operator is not a party to the sales contract between the Pharmacy and the Patient, does not accept payments for products and does not guarantee the number of Inquiries, their value or that the Patient will collect a reservation. An Inquiry may reach more than one pharmacy; the Patient receives the Answer of the one that answers first.

3.8 A Patient may send an Inquiry in any locality in which at least one active pharmacy with a location indicated on the map operates.

§ 4 Order in Which Inquiries Are Passed On

4.1 The Inquiry reaches pharmacies one after another according to the straight-line distance between the location indicated by the Patient and the pharmacy’s point on the map, within the range chosen by the Patient, and only pharmacies that are open at the time of the Inquiry according to the hours given in the Panel. The Service compares opening hours with the time in force in Poland.

4.2 The Patient chooses the range: their own locality or a radius of 5, 10 or 20 km. In the “my locality” range only pharmacies in the same locality receive the Inquiry. The Patient’s location is the position shared by their device or, where they have not shared it, the average position of the pharmacies operating in the locality they gave.

4.3 The nearest open pharmacy receives the Inquiry first; the next one joins after about 10 minutes, unless the Inquiry is put on hold by a conversation with the Patient or by a one-time hold by the pharmacy. Earlier pharmacies keep the ability to answer. The Patient receives the Answer of the pharmacy that answers first. An Inquiry of a Patient with a Premium plan reaches the two nearest pharmacies at once. A repeated Inquiry after a pickup reaches first the pharmacy that handled the previous one, if it is still within range and open.

4.4 Passing the Inquiry on to the next pharmacy is put on hold in two cases:

  • a) when the pharmacy asks the Patient a question in the conversation — until the Patient replies, for no longer than 10 minutes;
  • b) when the pharmacy uses the “busy” option in the Panel — for 15 minutes, once for a given Inquiry.

These periods do not add up and do not extend the time limit under clause 4.6.

4.5 Once the first Answer is recorded, the other pharmacies lose the ability to answer that Inquiry and receive an e-mail about it.

4.6 An Inquiry that no one has answered expires 60 minutes after it is sent, or earlier — when all pharmacies within range have received it and a further 10 minutes have passed.

4.7 After receiving an Answer the Patient may reserve a pickup, cancel the Inquiry or ask a further pharmacy. The Patient may use the last option at most twice for one Inquiry. The previous pharmacy’s Answer then ceases to apply, the pharmacy receives an e-mail about it without a reason being given and does not receive the same Inquiry again.

4.8 No fee, Plan, history of answers or rating affects the order. The arrangements under clause 6.9 may not concern it.

4.9 In the Panel the Pharmacy sees whether another pharmacy also has the same Inquiry, and the distance of the next pharmacy from the Patient. It does not learn the name or any other data of the other pharmacies.

§ 5 Conclusion of the Agreement, Registration and Activation

5.1 The agreement is concluded at the moment the Terms are accepted in the application form. The Operator records the version of the Terms, the date and time of acceptance and the first and last name of the person who gave it, and sends the text of the Terms in that version to the Pharmacy’s e-mail address. The person accepting declares that they are entitled to represent the entity running the pharmacy. The Cooperation Service is provided from the activation of the account.

5.2 The acceptance field in the form reads: “I accept the Cooperation Terms for Pharmacies and confirm that I have read the information on data processing. I declare that I have the right to represent the entity running the pharmacy.”

5.3 Before activation the Pharmacy provides: the business name and NIP of the entity running the pharmacy, the name and address of the pharmacy, the permit number, telephone number, e-mail address, opening hours (one daily interval or “24 hours”), the location of the pharmacy on the map and the first and last name of the person submitting the application. The e-mail address must be confirmed by a link valid for 48 hours.

5.4 The agreement concerns one pharmacy. An entity running more than one pharmacy creates a separate account and concludes a separate agreement for each of them. One account can be created per e-mail address.

5.5 The Operator activates the account after confirming the pharmacy in the Pharmacy Register. The Operator may refuse activation if the data cannot be confirmed; it refunds in full any fee paid before the refusal.

5.6 The Pharmacy receives Inquiries when the account is active and has a location indicated on the map.

5.7 A Pharmacy that created an account before 11 October 2026 accepts the Terms at its next login to the Panel. Until acceptance it does not receive Inquiries.

§ 6 Fees

6.1 Until the Law Change Day the Cooperation Service is free of charge. The Operator activates accounts without a fee and does not accept payments for Plans.

6.2 From the Law Change Day the Cooperation Service is paid. The fee is fixed and does not depend on the number of Inquiries, Answers or pickups or on the value of the Pharmacy’s sales. To a Pharmacy whose account was activated free of charge, the Operator sends by e-mail the price list and a deadline for choosing a Plan, no shorter than 30 days from that message. If the Pharmacy does not pay for a Plan within that deadline, the agreement expires without any amounts owed, and the Operator switches off the account.

200,00 zł
Gross price (VAT 23%):

24 months
Net price:
2 400,00 zł
Gross price (VAT 23%):
2 952,00 zł
Payment method:
one-off, in advance for the whole period

6.4 The prices in the Terms and in the Service are net prices; to each the Operator adds VAT at the rate in force on the day of payment (currently 23%). Before payment the Service shows the gross amount. The fee is payable in advance, by card or another method made available by the payment provider (Stripe). The Operator does not store card data. In the Monthly Plan the Pharmacy authorises the Operator to collect the fee for each subsequent month from the payment method given, until cancellation.

6.5 The Operator issues an invoice to the details given by the Pharmacy in the account (business name, NIP, address) in accordance with the rules on the National e-Invoicing System (Krajowy System e-Faktur, KSeF) and sends its visualisation or KSeF number to the Pharmacy’s e-mail address. The Pharmacy provides the invoice details before payment and is responsible for their accuracy. The Operator documents a refund of the fee with a corrective invoice.

6.6 One pharmacy may have one Plan at a time. The period of a Plan paid for as a one-off starts at the moment the payment provider confirms payment. The billing period of the Monthly Plan is determined by each invoice paid through the payment provider.

6.7 A pharmacy may use the “Pilot” Plan once. The scope of the Cooperation Service during the pilot is the same as in the other Plans.

6.8 A change of Plan during a paid period requires contacting the Operator; the Operator then settles the unused part of the previous Plan under clause 8.4.

6.9 An entity running more than one pharmacy may, after the pilot has ended, agree with the Operator by e-mail a different amount of the fee and a different billing period for its pharmacies. The arrangement does not and may not cover the order in which Inquiries reach pharmacies, the number of Inquiries or any other way of allocating them; in this respect § 4 applies to every pharmacy without exception.

6.10 A change to the price list takes place under § 14 and does not change the price for a period already paid.

§ 7 SMS Notifications

7.1 SMS notifications of new Inquiries are an add-on which the Pharmacy switches on in the settings, provided the Operator makes this channel available. The SMS is sent to the Pharmacy’s telephone number when a new Inquiry arrives, when the Inquiry has not been opened for 5 minutes and when the Patient has cancelled it. The content of the SMS does not contain the Patient’s data or the items of the Inquiry.

7.2 SMS notifications are free of charge. The counter of messages sent in the Panel is informational and does not create any amounts owed.

7.3 The Operator may introduce a fee for SMS only by way of a change to the Terms, no earlier than 30 days after notification; the fee will not cover messages sent before the change.

7.4 The Operator does not guarantee SMS delivery; the primary channel of notifications is e-mail and the Panel.

§ 8 Cancellation, Refunds, End of the Period

8.1 Refund within 14 days. Within 14 days of the first payment the Pharmacy may cancel any Plan and receive a refund of the whole amount, provided that it has not answered any Inquiry.

8.2 Pilot. Apart from clause 8.1, the fee for the pilot is non-refundable. After 3 months the agreement expires; nothing is renewed and nothing is charged.

8.3 Monthly Plan. The Pharmacy may cancel at any time, with effect at the end of the paid month. The fee for the current month is non-refundable. If the cancellation arrived before the renewal and the card was nevertheless charged, the Operator refunds that charge.

8.4 “12 months” and “24 months” Plans. The Pharmacy may cancel at any time, with effect at the end of the current month of the agreement. The refund equals the net payment reduced by 200 zł for each month begun; if the result is negative, the refund is zero. Example: “12 months” Plan, cancellation in the third month: 1 440 zł − 3 × 200 zł = 840 zł net; cancellation in the eighth month: refund zero. To the net amount refunded the Operator adds the corresponding part of the VAT paid.

8.5 Reason on the Operator’s side or good cause. The Pharmacy receives a refund of the fee for the unused period, calculated to the day, without the recalculation under clause 8.4, when: the Operator ends the provision of the Cooperation Service; the Operator changes the Terms and the Pharmacy terminates the agreement under § 14; the Pharmacy terminates the agreement for good cause; the Pharmacy loses its permit; an authority initiates proceedings against the Pharmacy referred to in clause 10.6.

8.6 How to cancel. The Pharmacy sends the cancellation by e-mail from the account address to biuro@webet.pl. The Operator confirms it within 2 working days and cancels the collection of fees. The refund is made within 14 days, by the same payment method, with a corrective invoice.

8.7 End of the paid period. At the end of the paid period the agreement expires. The Operator switches off the account within 14 days; it charges no fees for Inquiries handled after the end of the period and no amount becomes owed.

8.8 Failed payment in the Monthly Plan. The payment provider retries the collection according to its own schedule. If the fee is not received within 14 days, the Operator may suspend the account after a notification with reasons and, after a further 30 days, terminate the agreement. The Operator does not claim fees for a period without payment.

8.9 After the agreement ends, the Pharmacy has no access to the Panel; it will receive a statement of its Answers and settlements on request within 30 days.

§ 9 Pharmacy’s Obligations and Content of Answers

9.1 The Pharmacy gives in the Answer information consistent with the facts at the moment it is entered. The Answer covers all items of the Inquiry. For a non-prescription item the Pharmacy indicates: “available”, “unavailable” or “substitute”. For a prescription item: “available”, “unavailable” or “to order for tomorrow”.

9.2 For non-prescription items that the Pharmacy can dispense, the Pharmacy gives a total price or the price of each item.

9.3 For a prescription item that the Pharmacy marks as available, the Pharmacy gives the price: for a full-price medicine — its retail price, for a reimbursed medicine — the patient’s co-payment resulting from the official price and from the co-payment level given by the patient. The price is an individual answer to the patient’s inquiry, is indicative until the prescription is presented and is not published anywhere. The Pharmacy dispenses a prescription medicine only on the pharmacy’s premises, on the basis of a valid prescription. The price of a prescription item does not form part of the total amount of the Answer and is not compared with the prices of other pharmacies.

9.4 The Pharmacy’s Answer contains only: availability, quantity, price, the name of a substitute and organisational information concerning pickup. In the Answer or in the conversation with the Patient the Pharmacy does not include: (a) discounts, coupons, points, free gifts or other benefits for a purchase or for further purchases; (b) comparisons with other pharmacies or their prices; (c) content on the properties or indications of medicinal products; (d) any inducements concerning prescription medicines and reimbursed products. The Operator may remove content contrary to this clause and suspend the ability to add it.

9.5 The Service does not accept in the Answer any additional commercial information or promotions of the Pharmacy.

9.6 The price of the non-prescription part given in the Answer binds the Pharmacy until the end of the pickup deadline, unless the Pharmacy marked it as requiring confirmation or the price is an obvious mistake.

9.7 When the Patient reserves a pickup, the Pharmacy sets aside the products indicated in the Answer until the pickup deadline visible in the Panel (240 minutes from the reservation) expires.

9.8 The Pharmacy hands over the order to the person who gives the Pickup Code and confirms the handover by entering the Pickup Code in the Panel. The Pickup Code can be confirmed only by the Pharmacy that gave the Answer. The Pickup Code serves to link the person at the counter with the Inquiry, not to verify identity, and does not replace a prescription.

9.9 The Pharmacy keeps its current opening hours and location on the map up to date in the Panel. The Panel accepts one interval of hours for all days or the designation “24 hours”; on a day on which the pharmacy is closed or works shorter hours, the Pharmacy changes the hours in the Panel itself.

9.10 The Pharmacy has no obligation to answer an Inquiry within a set time. An Inquiry without an Answer goes to the next pharmacies and expires in accordance with § 4.

9.11 The Pharmacy holds the conversation in the Panel solely in connection with the given Inquiry. A message has up to 200 characters. Only a pharmacy that is participating in an ongoing Inquiry may write.

9.12 An Inquiry and the reservation of a pickup are not a distance sale or an order placed with the Operator. The Patient concludes the sales contract with the Pharmacy on its premises at pickup.

9.13 The Pharmacy protects access to the Panel: it does not pass login links to unauthorised persons and promptly informs the Operator of any suspicion of access by an unauthorised person. The Pharmacy is responsible for actions performed in the Panel after logging in from the account’s e-mail address.

9.14 Placing unlawful content in the Panel is prohibited. Anyone may report such content to the address in clause 1.3; the Operator handles the report in accordance with § 15.

§ 10 Liability

10.1 The Pharmacy bears sole responsibility for: the consistency of the Answer with the facts, the price and availability, the handing over of products in accordance with the regulations, including the dispensing of a prescription medicine solely on the basis of a valid prescription, and for the content entered in the Panel.

10.2 The Operator is responsible for passing on Inquiries and Answers and for the operation of the Panel on the terms of the Terms. It does not guarantee uninterrupted operation of the Service; it informs of planned technical work in advance as far as possible.

10.3 The Operator’s liability to the Pharmacy under the agreement is limited to actual loss (excluding lost profit) and to the amount of net fees paid by the Pharmacy for the 12 months preceding the event. The limitation does not apply to damage caused intentionally.

10.4 The Pharmacy releases the Operator from claims of patients and from penalties arising from the content of its Answers or from the manner in which products are handed over, and the Operator releases the Pharmacy from claims and penalties arising from the manner in which the Service operates.

10.5 The provisions on the advertising of pharmacies (Article 94a and Article 129b of the Pharmaceutical Law) are in the course of being amended. The Operator has shaped the Cooperation Service so that it is not advertising of a pharmacy, but does not guarantee that a body of the Pharmaceutical Inspectorate (Inspekcja Farmaceutyczna) will assess it in the same way. The Pharmacy is responsible for the content of Answers; the Operator is responsible for the manner in which the Service operates.

10.6 If an authority initiates proceedings against the Pharmacy in connection with its use of the Cooperation Service, the Pharmacy may terminate the agreement with immediate effect and receive a refund of the fee for the unused period, calculated to the day.

§ 11 Patients’ Data

11.1 The Operator and the Pharmacy are separate controllers of the Patients’ personal data. The Operator makes the data from the Inquiry available to the Pharmacy on the basis of the Patient’s explicit consent. The Pharmacy processes them on its own behalf, for the purpose of preparing the Answer, the reservation, the sale and the handing over of products, on the basis of Article 6(1)(b) and Article 9(2)(h) GDPR.

11.2 The parties do not conclude a data processing agreement; neither processes the Patients’ data on behalf of the other.

11.3 The scope of data depends on the Pharmacy’s relation to the Inquiry:

The Pharmacy’s relation to the Inquiry: The Pharmacy is participating in an ongoing Inquiry (it has received it and can answer, or its Answer is awaiting reservation or pickup)
What the Pharmacy sees in the Panelthe Patient’s first name, if they gave it in their account; the locality and the chosen range; the Patient’s distance from the Pharmacy, without coordinates; the names, packages and quantities of products, including prescription medicines with the declared co-payment; the comment and the conversation; the telephone number, if the Patient gave it; the lowest total price of the non-prescription part in online pharmacies at the moment the Inquiry was sent; after reservation the Pickup Code and the pickup deadline
The Pharmacy’s relation to the Inquiry: The Pharmacy gave an Answer and the Inquiry has ended — for 24 hours from the End of the Inquiry
What the Pharmacy sees in the Panelthe same without the telephone number
The Pharmacy’s relation to the Inquiry: The Pharmacy gave an Answer — after 24 hours have elapsed from the End of the Inquiry
What the Pharmacy sees in the Panelonly the items of the Inquiry with its own Answer, the amounts and the times; without the first name, locality, conversation and Pickup Code
The Pharmacy’s relation to the Inquiry: Any other pharmacy that received the Inquiry: another pharmacy answered earlier, the Patient asked a further one, the Inquiry expired or was cancelled without its Answer
What the Pharmacy sees in the Panelonly the list of items (name, package, quantity, indication of a prescription medicine), its own distance and the times; without data on the Patient, the conversation, the Pickup Code, the amounts and the Answer of another pharmacy; such a pharmacy cannot write in the conversation or put the Inquiry on hold

11.4 Outside the Panel the Pharmacy receives an e-mail with a list of up to eight items of the Inquiry (clause 3.3) and an SMS without the Patient’s data (clause 7.1). The Pharmacy never receives the Patient’s e-mail address, surname or coordinates.

11.5 The Pharmacy uses this data solely to handle the given Inquiry. It does not use it for marketing, does not pass it to anyone other than authorised persons bound by confidentiality, and does not copy it to its own systems, unless a legal provision requires it (e.g. documentation of the fulfilment of a prescription). The telephone number serves solely for contact concerning that Inquiry.

11.6 Access to the Patient’s data in the Panel expires within the time limits in clause 11.3. The Pharmacy deletes copies made outside the Panel, including e-mails with the list of items, within the same time limits.

11.7 The Operator gives the Patient the information on the processing of data by the Pharmacy (Article 14 GDPR) together with the Pharmacy’s Answer, in the wording set out in the Annex. The Pharmacy is responsible for the accuracy of its data in that information.

11.8 Each party itself responds to Patients’ requests concerning its processing and itself reports its own breaches. A party notifies the other party of a breach concerning data from Inquiries within 24 hours of establishing it, at the e-mail address indicated in the Terms or in the account.

11.9 When the Patient cancels the Inquiry or the Inquiry expires, the Pharmacy does not contact the Patient in connection with it.

11.10 Data that the Pharmacy itself collects from the Patient at the counter (for example when fulfilling a prescription) the Pharmacy processes as its controller, outside the Cooperation Service.

§ 12 Pharmacy’s Data and Access to Data

12.1 In the Panel the Pharmacy has access to the Inquiries it has received, its Answers, conversations, results and settlements; to the Patients’ data — within the time limits in clause 11.3.

12.2 The Operator retains the prices given in Answers for non-prescription items and makes them available to other pharmacies solely as a median from at least three pharmacies, without identifying the pharmacy. After the Inquiry is deleted, the price record has no link to the Patient. The Operator does not record prices of prescription items in this way.

12.3 The Operator processes the Pharmacy’s data given at registration and in the Panel (business name, NIP, name and address of the pharmacy, permit number, telephone, e-mail, opening hours, location, invoice details, first and last name of the person submitting the application) for the purpose of concluding and performing the agreement and for settlements. Where these are the data of a natural person, the rules on their processing are described in the Privacy Policy.

12.4 A Patient to whose Inquiry the Pharmacy has answered sees its name, address, telephone number and opening hours.

12.5 The Operator passes the Pharmacy’s telephone number and the content of SMS messages to the SMS service provider (SMSAPI), the account’s e-mail address and payment data to the payment provider (Stripe), and the content of e-mails to the mail provider (Twilio SendGrid).

§ 13 Suspension and Termination by the Operator

13.1 The Operator may restrict or suspend the Pharmacy’s account when: the Pharmacy has lost its permit or does not appear in the Pharmacy Register; the pharmacy’s data are untrue; the Pharmacy breaches clause 9.4 or § 11; the Pharmacy is in arrears with a fee for more than 14 days; a legal provision or a decision of an authority requires it. The Operator provides the reasons by e-mail at the latest at the moment of suspension.

13.2 Termination of the agreement by the Operator takes place with 30 days’ notice and with reasons, unless a legal provision requires otherwise or the Pharmacy has breached the Terms again.

13.3 The Pharmacy may submit explanations to biuro@webet.pl; the Operator replies within 14 days.

13.4 Suspension and termination of the agreement close the Pharmacy’s access to the Panel.

§ 14 Changes to the Terms

14.1 The Operator may change the Terms for good reasons: a change in the law, a decision of an authority, a change in the way the Cooperation Service operates, security considerations. It notifies of the change by e-mail at least 30 days before it enters into force, sending the new text.

14.2 The Pharmacy may, up to the day the change enters into force, terminate the agreement by e-mail; it then receives a refund of the fee for the unused period, calculated to the day.

14.3 A change does not operate retroactively and does not change the price for a period already paid.

14.4 The 30-day period does not apply to changes required by a legal provision or a decision of an authority with a shorter time limit, or to editorial changes.

§ 15 Complaints and Contact Point

15.1 Complaints about the Cooperation Service and reports of unlawful content are received by the contact point: biuro@webet.pl, in Polish. The Operator confirms the report within 3 working days and replies within 14 days, giving reasons.

15.2 The Operator is a small enterprise within the meaning of Recommendation 2003/361/EC and does not designate any mediators; the parties may agree on mediation in any matter.

15.3 Complaints of the Patient concerning the product, the price or the handing over are handled by the Pharmacy. Complaints of the Patient concerning the operation of the Service are handled by the Operator. Each party passes to the other without undue delay a report that does not concern it.

§ 16 Final Provisions

16.1 The Terms in version 1.0 apply from 11 October 2026.

16.2 The agreement is governed by Polish law. Disputes are resolved by the court competent for the Operator’s registered office.

16.3 If any provision of the Terms proves invalid or unenforceable, the remaining provisions retain their force.

16.4 The current and previous versions of the Terms are available in the Service.

Annex. Pharmacy’s Information for the Patient (Article 14 GDPR)

The Operator shows this information to the Patient together with the Answer, completing the name, address and telephone number of the Pharmacy from its account.

The pharmacy that answered is also a controller of the data from your inquiry: [pharmacy name], [address], tel. [telephone number]. The pharmacy received this data from WEBET Sp. z o.o., with your consent. It comprises: your first name (if it is on your Account), locality, names and quantities of products, comment and conversation, telephone number (if it is in the inquiry) and the pickup code.
